Terms & Conditions for Job-Hunters and Recruitment Companies/Recruiters

You MUST READ FIRST – SECTION I. GENERAL TERMS OF USE before you read any other sections. Section I. apply to each section.

This Section of the Website is owned and operated by BEST SEARCH LIST and is made available to you on the following terms and conditions (Terms of use). By using the Website and the services available on it. you are deemed to accept these Terms of use and any additional terms and conditions which expressly apply to services and information provided by third parties.

If apply any third party’s Terms and Conditions to this Website, please read it carefully because we do not have control over it.

‘Job-Hunter’: ‘You’ and ‘Your’ means any person signing up with us and using free of charge or purchasing any of our services to assist with your job search needs.

‘Recruiter’: ‘You’ and ‘Your’ means any person, sole trader, company, organisation or firm which uses free of charge or purchases services from us to assist your hiring needs.

General Terms

I. We are NOT RECRUITMENT AGENCY, we provide the JOB BOARD information for your convenience only. The information and services available in this Section on the Website are provided for the sole purpose of individuals looking for employment opportunities (career information and development) and for employers seeking to recruit and hire staff. You may use, print and download information from the Website for these purposes only and no other personal or commercial purpose. You MAY NOT otherwise copy, display, transmit or distribute any content from the Website.

II. All copyright, database rights and other intellectual property rights in the Website and the content available to use in this Section on the Website belong to BEST SEARCH LIST or its third-party suppliers. Use of this Section of the Website does not give you any proprietary rights in such content. You agree not to deep-link and/or frame to this Section of the Website or any of the Services for any purpose unless our written consent to do so.

III. BEST SEARCH LIST will permit the Job-Hunter and Recruiter to access, use and interact with this Website subject to these Terms of use in this Section. Any party using this service for any purpose other than those specifically stated in these Terms of Use shall immediately be banned or removed from using this Website.

IV. We try to ensure continuous availability of this Section of the Website and all the services available on it but accept no responsibility for the consequences of interruptions, or delays, however, caused and appear beyond our reasonable control. We do not warrant that this Website or Services will operate without errors or that the Website or services are free from infection by viruses, worms or anything else which has contaminating or destructive properties and we shall have no liability in respect thereof.

V. Job-Hunters and Recruiters need to be aware that BEST SEARCH LIST does NOT introduce or supply Job-Hunters to Recruiters. It is recommended that:

V.1. If you are a Job-Hunter to ensure your availability and suitability for the role advertised or,

V.2. If you are a Recruiter, to ensure a work seeker’s suitability for the role
(You both should undertake the steps set out in The Conduct of Employment Agencies and Employment Business Regulations 2003 if you use them in the UK).

V.3. If you are a Recruiter, in any other country outside the UK, you have to comply with local country laws for employment.

VI. You agree that you shall not use this Section of the Website or the Services to transmit or knowingly or recklessly receive (or knowingly or recklessly authorise or permit another person to receive or transmit) content which is obscene, threatening, menacing, offensive, defamatory, abusive, untrue, in breach of confidence, in breach of any intellectual property right (including copyright) or which may cause fear and anxiety to others including racist or erotic content or material which otherwise violates any applicable law or regulation or code, contains any viruses or which may otherwise harm our business, harm our or any third party computer system.

VII. Any warranties or terms are made in respect of the Website and/or the Services or their contents (including, without restriction, any views or comments made). All data included in this Section on the Website, the Services and/or in any directory or other listings or information retrieval service made available on or by the Website and/or the Services has been so made available for information only. BEST SEARCH LIST makes no representations or warranties about the accuracy, completeness, or suitability of any purpose of the information and related graphics published on this Website. Please check with our provided members the information contained in this Website because may contain technical inaccuracies or typographical errors. If you rely on visible information only on this Website your use of such information and/or data is therefore entirely at your own risk. All liability of BEST SEARCH LIST, howsoever arising for any loss suffered as a result of your use of the Website and/or the Services is expressly excluded to the fullest extent permitted by law.

Limitations in these terms of use are intended to limit any rights you may have as a consumer under local law which may not be excluded nor in any way to exclude or limit BEST SEARCH LIST liability to you for death or personal injury resulting from our negligence or negligence of our members (agents).

However, we shall have the right to ban or remove any postings, information or other items on the Website which it believes may not be accurate, illegal or which it determines to be inappropriate.

XI. You agree and accept, indemnify, and hold harmless BEST SEARCH LIST, its affiliates, and their respective members, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging from

XI.1. Any User/Member content or other information materials you provide to us;

XI.2. Your use of any BEST SEARCH LIST content;

XI.3. Your breach of these Terms of use. BEST SEARCH LIST shall provide notice to you promptly of any such claim, suit, or proceeding.

XII. These Terms of Use will remain in full force and effect while you are a User or Member of any of our websites. We reserve the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to the removal of your Content from our website and immediate termination of your account with, or ability to access the, BEST SEARCH LIST website and/or any other services provided to you by us, upon any breach by you of these Terms of use or if we are unable to verify or authenticate any information you submit to this website. Even after you are no longer a User/Member of the BEST SEARCH LIST website, certain provisions of these Terms of Use will remain in effect. We may terminate, suspend or deny you access to the Website and/or Services immediately for any reason without any notice or incurring any liability whatsoever to you.

XIII. Where you are asked to complete a Signup form the personal details that you provide must be true, accurate and complete. You agree to notify us of any changes which are relevant to your account registration.

XIII.1.Your personal information data will be collected and processed by BEST SEARCH LIST under its privacy policy. You hereby agree and accept these terms of use in our privacy policy by your agreement to the terms and conditions of this Agreement (Terms of use).

XIII.2. This Agreement shall be personal to you and you may not assign, transfer, sublet, lease or delegate all or any of your rights and obligations, without our prior written consent.

XIII.3. BEST SEARCH LIST reserves the right to assign or transfer all or any of its rights and obligations under this Agreement to any companies, Sole Trader or any other third party. In the event of assignment or transfer of all or any of its rights and obligations, notification will either be given to you by e-mail or posted on the Website.

XIV. Neglect or failure by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate to bar that exercise or enforcement thereof or of any other right on any later occasion.

XV. If any provision of this Agreement or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms of use, and provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.

XVI. Entire agreement. This Agreement constitutes the entire agreement between the parties in respect of its subject matter NOTWITHSTANDING that we reserve the right to change, amend and update this Agreement without notice to you from time to time (including the services offered by us). It is your responsibility to read and accept this Agreement every time you use this Website. Such changes in this manner shall be deemed to have been accepted if you continue to use this Website and/or the Services.

XVII. Any notices from us to you, or you to us, shall be sent by email or the contact form provided.

XVIII. This Agreement shall be governed by the laws of England and Wales and you hereby submit to the exclusive jurisdiction of the English courts.

Terms of use for Job-Hunters

I. You acknowledge and agree that you are solely responsible for the form, content, accuracy and completeness of any resume or information contained therein submitted by you on the BEST SEARCH LIST website. In subject to the contact details you provide, you should be aware that you may be contacted directly by Recruiters by email, post or telephone.

II. We reserve the right to offer third-party services and products to you based on the preferences that you identify in your registration form and at any time thereafter or you have agreed to receive, such offers may be made by us or by third parties. For further details, you can see our Privacy Policy.

III. The Job-Hunter is liable if they are contacted by the Recruiter in this Section without intervention from the BEST SEARCH LIST.

IV. BEST SEARCH LIST does not discriminate against anyone registered to or using this website. We try to ensure that all possible measures are taken to prevent any vacancies advertised or searches do not discriminate against age, disabilities, gender or race. The search tools in place on the website do not have the functionality to exclude any Job-Hunters with disabilities. It is down to the users themselves to ensure they comply with discrimination laws.

V. All services and information provided on the website by us and our third-party partners are intended to assist in the job-seeking or recruitment process.

VI. We do not verify any provided information by recruiters. You have to do further research about the hiring company. If you rely on this information you have to do it at your own risk.

VII. Neither we nor our third-party partners can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the website in circumstances which may result in loss or damage.

VIII. Our liability, and the liability of our third-party partners, for any loss or damage suffered by you as the result of your use of this website is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future profit a company or sole trader, earnings, or prospects or any consequential or speculative loss. This exclusion does not extend to death or personal injury caused by our negligence.

IX. You understand and acknowledge that you have NO OWNERSHIP rights in your account and that if you cancel your account or your account is terminated or removed because of any reason, all your account information from BEST SEARCH LIST, including resumes, profiles, cover letters, saved jobs, questionnaires will be marked as deleted and will be deleted from our databases within a reasonable time frame. Our third-party partners may retain saved copies of your personal information.

X. BEST SEARCH LIST reserves the right to delete (remove) your account and all of your personal information after a significant duration of inactivity in this section or the event that any of our terms have been breached by you.

XI. By registering your resume on BEST SEARCH LIST you agree that we may also store and show your resume, motivation letters, cover letters and profile details, to recruiters, on any other job board owned directly by us.

XII. Most of the services in the BEST SEARCH LIST are FREE OF CHARGE at the moment. We do not guarantee that services in this section will be free of charge in the future. We may change any of our services in a one-off payment or monthly subscription plan.

Terms of use for Recruiters

I. You will be deemed to have accepted all of these terms of use and will be granted access (subject to receiving payment by us for our charged services only) to our resume and other databases under these terms of use on receipt of your submitted information via our on-line registration form, email or signed service agreement.

II. If you acting as a Business owner, you also agree that all of the company or sole trader information you supply to us is correct, accurate, truthful and complete.

III. You agree to contact and inform us by email, or editing your online profile if you have any changes to any of the information supplied by you to us. We reserve the right to terminate this agreement (and remove your account) if any of the information provided by you to us, is no longer current or accurate, truthful and complete, or in the event, you are in breach of these Terms of use.

IV. We will take reasonable steps to provide a reliable service to you on this website. However, we CANNOT guarantee the accuracy or authenticity of any of the resumes stored in our database.

V. We don’t verify any provided information by Job Hunters. You must use the interview or any other further hiring steps in the recruitment process to verify any ID, skills and experience applying to the Job-Hunters. You acknowledge and accept that this is beyond our control (because we can not verify this information), and refunds cannot be given in the event of untruthful information being submitted by JobHunters using this website.

VI. You acknowledge and accept that all rights to the information provided by third parties or partners (this includes Job-Hunters) are reserved by those third parties and that such information may not be used in any way that infringes any proprietary interests of those third parties. You agree not to disclose any information provided by the Job-Hunters to any third parties, your partners, or those not directly related to the recruitment process of the individual(s) in question.

VII. You acknowledge and accept that you as a Business owner or Sole Trader will at all times comply with the provisions of current data protection (GDPR) legislation. And you will not, by any act or omission cause BEST SEARCH LIST to be in breach of current data protection legislation in any country.

VIII. You acknowledge and accept in this section that you are acting as a data controller for current data protection legislation (GDPR) in connection with any personal data obtained in the provision of the services by BEST SEARCH LIST in any country. It is your responsibility as a Business owner to comply with your obligations as a data controller and to satisfy yourself with the legal grounds for processing any personal data or information by the local country laws.

IX. BEST SEARCH LIST acknowledges that it will act in this section as a data controller for current data protection legislation (GDPR) and that it will comply with its legal obligations in the provision of the services we provide.

X. Any personal details that you provide in this section to us from which we can identify you are held under our Data Protection Registration (GDPR). You are obliged to have a lawful basis for the transfer of any personal data you provide to us.

XI. You agree that you do not object to us using this information to contact you to improve our service to you in this section, requesting payment(s) for charged services only, discussing account status, and you confirm that you do not consider any of the above as a breach of any of your rights.

XII. Downloading or leeching our resume database, wholly or in part, for any reason other than recruiting for a current vacancy is strictly forbidden and will result in immediate cancellation and removal of your account, without refund if you purchase any service. Downloading using any software other than a compatible browser is also strictly forbidden and will result in immediate cancellation and removal of your account, without a refund. Legal action may be taken against you if you breach this term of use. BEST SEARCH LIST’s database usage functions on a search and selection process; resumes must be previewed to ensure relevancy against specific information about job vacancies before download. Bulk downloading resumes is not permitted.

XIII. Contacting Job-Hunters via email or other means, for any reason other than recruitment (such as promoting offers), is strictly forbidden.

XIV. You agree not to put excessive upload or download on our servers. If you are a business owner/agency/sole trader you can have ONE account only. Multiple accounts are forbidden. If you want to have more than one account you have to contact us and discuss it with us. If any unauthorized users attempt to access the account, or if the account is accessed from other locations, we reserve the right to cancel and remove your account immediately, without a refund.

XV. You must use the BEST SEARCH LIST databases under all applicable privacy and data protection laws, and you agree and accept you shall not further disclose any of the data from our resume databases to any third party or partners unless you are an authorized recruitment agency, staffing agency, advertising or other agency or using the resumes explicitly for employment purposes.

XVI. You agree to deal fairly and professionally with individuals who may respond to an ad you have posted and not do anything which may cause BEST SEARCH LIST into disrepute. You will indemnify us from and against any claim brought by an individual against BEST SEARCH LIST arising from your breach of this obligation or any other of these Terms of use.

XVII. We do not guarantee any response to your advert or that those responses will be from individuals suitable for the job you posted. It is your responsibility to carry out such further checks and procedures as are necessary to ensure that Job-Hunters are suitable for the work advertised by your company and have the required qualifications and personal characteristics to do the job.

XVIII. We have rules regarding the content and format of jobs posted on the BEST SEARCH LIST. Their purpose is to ensure that Job-Hunters who search the website or our databases get results which are presented with accuracy as clearly and informatively as possible. You agree and accept that we may, at our discretion and without liability to you, remove from BEST SEARCH LIST any advert which is posted in breach of these rules. The rules may change and amend at any time and you are advised to refer to them regularly when you use this website.

XVIII.1. The job posted must exist in the city or town advertised unless it is a franchise opportunity (which must be clearly stated in the description).

XVIII.2. The job title should be specific and be the best description for the advertised role. It MUST NOT include locations, salaries or company brand names, and should not be a slogan (for example Great Opportunity to Make Money).

XVIII.3. Company/Brand Emails and website URLs within job descriptions are NOT ALLOWED. We will remove any ads that contain this information and restrict account access.

XVIII.4. Premium rate or Extra charged phone numbers MUST NOT be used on job adverts.

XVIII.5. The description of the role must contain the required skills as well as details describing the role and responsibilities of the Job-Hunter. Contact names must not be mentioned in the job description. Recruitment agencies / Sole Traders are only permitted to include the Client Name / Brand Name that they are recruiting on behalf of once within the description unless client-branded adverts have been purchased.

XVIII.6. If the job role offers training (or skills development) and there is a CHARGE for this then the vacancy must state this in the description and this vacancy will then be branded with our ‘more skills, more money’ banner. All training and development courses MUST be advertised separately within our training widget sections on the website.

XVIII.7. Adverts which discriminate against any person (or appear to discriminate) on grounds of sex, race, age or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. Adverts are accepted by BEST SEARCH LIST on the basis that the advertiser/publisher confirms that any requirement or qualification which may appear to discriminate illegally complies with any exemption available under the relevant legislation. If we nonetheless believe that adverts may be discriminatory we may at our sole discretion either amend the ad or remove it from our database without liability to you to make any refund of amounts paid or due to be paid (for our charged services only) in respect of the posting or otherwise and will inform you accordingly.

XVIII.8. The vacancy/role description should accurately describe the role and not mislead the Job-Hunter; sufficient detail should be included for the Job-Hunter to understand the nature of the role and the basic requirements and responsibilities of the role. If a role requires a Job-Hunter to work in multiple locations then the vacancy must state this; if the role is selling a product/service ‘door-to-door’ then the vacancy must state this clearly; similarly, if the role is a commission based only then this must be stated on the vacancy description clearly.

XIX. To protect our Job-Hunters from job scams and fraud, recruiters MUST NOT request payments during the recruitment process. Any reports made to BEST SEARCH LIST will be investigated and may lead to the termination and removal of your account without a refund (for our charged services only).

XX. All admin or other specific information requested from and provided to you is confidential. You MUST not disclose your password to any person(s). If disclosure occurs we reserve the right to terminate this agreement, remove your account immediately and seek compensation. Your selected password is for the sole use of our system. Passwords MUST be kept confidential and secure at all times. We may deny access to your account (username and password) if we reasonably believe that it is being used by an unauthorised person or that the user/member is breaching these Terms of use. You agree to notify us as soon as reasonably possible if your password is, or maybe, known to any person(s). You MUST change (update) your password periodically to ensure better security on your account. Other than through our negligence or wilful default, we shall not be liable for any losses, damages or claims which result directly or indirectly from any person obtaining any passwords.

XXI. We are NOT a Recruitment Agency, and we are not responsible for the content of job adverts from different employers/agencies. If you have an issue with a job advert that is not your own, you should deal with this directly with Advertiser or Publisher and not through us.

XXII. Payment Terms for our charged services only

XXII.1. Job posting credits MUST be used within the Fixed Term – one month; time will not be extended for job credits that have not been posted or posted part of the way through the Fixed Term (for example, if you sign up for an account and purchase job credit over a one month fixed term and this is started on the 18th day on the month, the job will expire on the last day of the one month fixed term or 17th the next month).

XXII.2. You agree to pay the entire balance of your account before the commencement of the service (unless an alternative payment structure is agreed upon in writing). You agree that payments will be made by PayPal or bank transfer. You acknowledge and agree that in the event of failure by you, or the person with whom responsibility lies for payment of such transactions, we may suspend or terminate your account and cancel this agreement immediately. We may pursue payment in a court of law also.

XXII.3. Any alternative payment structure may be agreed upon with your account manager, and agree to be charged under it.

XXII.4. If you do not wish to continue this agreement, you may terminate the agreement at the end of your Fixed Term.

XXII.5. We may agree to monthly payments by way of Direct Debit. Direct Debits will be taken in advance of services used and will be set. You will be notified in writing of the amount debited and the Fixed Term. If one payment is missed then the monthly instalment must be settled immediately, and your account and all services will be suspended until payment is received. If two payments are missed the account will be cancelled and no future Direct Debits will be granted and the outstanding amount for the remainder of the fixed term will become due immediately, BEST SEARCH LIST reserve the right to pursue payment in a court of law also.

XXII.6. All prices include VAT. All invoices are payable under the Service Agreement provided to you by us. Late payment will entitle us to suspend the provision of all Services in this section. Interest will be payable on late payments at the rate of 3%.

XXII.7. Refunds cannot be provided if the Job-Hunter is not of the desired age, sex, race, or nationality, as these criteria contradict our equal opportunities policy, and common decency.

XXIII. The Terms of use of this agreement will continue unless terminated by you or us, by notice under this section below.

XXIII.1. We reserve the right to terminate this agreement immediately, and remove your account from our system and payment will become due immediately for all outstanding amounts. BEST SEARCH LIST will have no further obligation to you, upon the occurrence of any of the following events:

XXIII.1.1. You fail to make payments of any amount due to us;

XXIII.1.2. You are a Business Owner/Agency and your limited company is subject to proceedings under insolvency, you cease to trade or go into liquidation;

XXIII.1.3. You are an individual and are declared bankrupt or enter into any arrangement or compromise with your creditors, or you cease to trade;

XXIII.1.4. The Recruiter is in breach of these terms of use and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied.

XXIII.2. The Business Owner/Agency/Recruiter/Sole Trader may terminate the provision of Services in writing to us via email:

XXIII.2.1. Each month – to expire at the end of the Fixed Term;

XXIII.2.2. If we are in breach of these terms of use and have not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied;

XXIII.2.3. BEST SEARCH LIST become insolvent, cease to trade or go into liquidation;

XXIII.2.4. Termination by the Recruiter/Agency/Client before the end of the Fixed Term may, at our discretion, result in loss of discounts agreed for the entire Fixed Term.
